ORDINANCE NO. #2017-ORD-R/R #91-4
AN ORDINANCE TO REPEAL AND RE-CREATE ORDINANCE NO. 91-4 OF THE TOWN OF COLD SPRING

WHEREAS, the since 1991 the Town of Cold Spring has elected to waive the municipal treasury bond requirement of Wisconsin Statutes §70.67(1); and

WHEREAS, the Town of Cold Spring hereby intends to continue to waive the municipal treasury bond requirement by updating the waiver to be consistent with current laws; and

NOW, THEREFORE, the Town Board of the Town of Cold Spring, Jefferson County, Wisconsin, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1: Town of Cold Spring Ordinance Number 91-4 entitled, “Town Treasurer’s Exemption from Bond” is hereby repealed and re-created as follows:

That the treasurer of the town is exempted from giving the bond specified in s. 70.67(2), Wis. Stats. That the town hereby obliges itself to pay (in case its treasurer fails to do so) all taxes of any kind which the treasurer is
required to pay to the county treasurer.

SECTION 2: Severability.
The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a court of competent jurisdiction to be invalid, unlawful or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and shall not affect the validity of any other provisions, sections or portions thereof of the ordinance. The remainder of the ordinance shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that
conflict.

SECTION 3: Effective Date.
This ordinance shall be effective upon publication or posting as provided by law.
