Road Right-Of-Way Ordinance #97-1

DEFINITION:

Road-right-of-way is 66 feet wide, 33 feet each way from the center of the road.

The Town Board of the Town of Cold Spring, Jefferson County, Wisconsin, hereby adopts the standard set by Wisconsin State Statutes 86.021(1) pertaining to highways, cultivation of injury by farm machinery.

The Town Board of the Town of Cold Spring, Jefferson County, Wisconsin, hereby adopts the standard set by Wisconsin State Statutes 86.03(3) planting trees and shrubs in highway right-of-way.

Now therefore be it hereby ordained that the Town Board of the Town of Cold Spring prohibits any object including crops, trees, shrubs, ornamental signs or any other decorative items that might be planted or erected in the road right-of-way.

Now therefore be it also ordained by the Town Board of the Town of Cold Spring that anyone putting an object in the road right-of-way is liable for any damage caused to a vehicle striking said object.

Now therefore be it also ordained by the Town Board of the Town of Cold Spring that any object including crops, trees, shrubs, ornamental signs or any other decorative items that are ordered removed, and not removed within 30 days after proper notification, will result in the issuance of a citation. The resident will be subject to a forfeiture of $50.00, the cost of removal, and legal fees.

This ordinance shall be effective upon adoption and publication.
